NRI Guide
How Should an NRI Choose an Executor for an Indian Will?
Updated August 5, 2026
An executor is the person you appoint in your Will to carry out your instructions: pay debts, distribute assets, file court papers, and coordinate with banks and registries.
For NRIs, executor choice is one of the most practical decisions in the entire Will.
What an executor actually does
After your death, the executor may need to:
- Locate and secure your Will
- Apply for probate or other certificates
- Close or transfer bank accounts and investments
- Handle property mutation and title transfer
- Communicate with heirs in different countries
- Hire lawyers and accountants in India
This is operational work — not just an honorary title.
Who makes a good executor for NRIs?
Strong choices
- Sibling or adult child living in India — can visit banks and government offices
- Spouse in India — if healthy and willing; consider age and stress
- Trusted lawyer or professional executor — costs fees but reduces family conflict
- Combination — family member + lawyer (where law permits co-executors)
Be cautious with
- Heirs who fight with each other — executor role amplifies tension
- Very elderly parents as sole executor
- Someone abroad with no India access — unless they can delegate effectively with legal help
- Beneficiaries under pressure — siblings may suspect bias (not illegal, but stressful)
Can an NRI be their own executor’s backup?
Yes. Many NRIs name:
- Primary executor: brother/sister in Mumbai or Delhi
- Alternate executor: another relative or lawyer if the first cannot act
Always name at least one substitute executor.
Executor vs power of attorney
| Executor | Power of attorney | |
|---|---|---|
| When active | After your death | While you are alive |
| Powers | Carry out Will | Act on your behalf per POA terms |
| Replaces Will? | No | No |
Do not confuse the two. Your executor needs a valid Will to act after death.
Practical checklist
- Ask the person before naming them — they can refuse if surprised
- Give them a copy of the Will or tell them where it is stored
- List asset locations (banks, property papers, passwords for portals — not full passwords in Will, but pointers)
- Consider lawyer review of executor clauses for complex estates
- Update executor choice if they move abroad or become unwell
If you have no one in India
Options include:
- Professional executor services or law firms in India
- EZWILL’s higher tiers with registration and case management support
- Appointing a trusted family lawyer as executor (discuss fees upfront)
Bottom line: The best executor for an NRI is someone who can get things done in India — not just someone you love most.
